Pursuant to the proposition number 1/27560 dated 31 October 2007 by Ministry of Communications and Information Technology and by virtue of the article (9) of the Act for Duties and Powers of the Ministry of Communications and Information Technology adopted in 2003, the Council of Ministers in its meeting of 15 June 2008 approved articles of association of Iranian Space Agency as follows:
Articles of association of Iranian Space Agency
Article 1: In an effort to execute legal duties and with the purpose of study, research, design, engineering and implementation in the area of technologies of space services and remote sensing and boosting communication networks and space technologies inside and outside Iran; and compilation of governing activities of Iran Remote Sensing Center and Ministry of Communications and Information Technology, Iranian Space Agency which is hereinafter called (“Agency”) is established by using the facilities and manpower of General Department for design, engineering and installation of satellite communications and General Department for maintenance of satellite communications of Iran Telecommunication Company.
Article 2: The Agency shall be a legal entity with financial independence and shall operate as a government institute affiliated with Ministry of Communications and Information Technology on the basis of its own financial rules and by-laws within the framework of laws and regulations.
Article 3: Duties and powers of the Agency are as follows:
a. To conduct study, research, design, engineering and implementation activities in the area of space services and remote sensing technologies and boosting of space networks inside and outside Iran and compilation of governing activities of Iran Remote Sensing Center and Ministry of Communications and Information Technology.
b. To prepare and regulate medium-term and long-term programs in the space sector of Iran in cooperation with relevant bodies in order to propose them to the competent authorities.
c. To conduct studies with the purpose of compilation of the policies of design, construct, launch and use research and applied satellites and render space services in order to propose them to the competent legal authorities.
d. To conduct research, design, construct and launch commercial, scientific and research satellites and design and construct national satellite launch and control center in cooperation with related bodies.
Note: The abovementioned activities except for the satellite launch and control center may be carried out by non-government sector under the supervision of the Agency.
e. To engage in planning with the purpose of direction and promotion of the peaceful use of outer space, celestial bodies, astronomy and space technologies, boosting of national, regional, and international communications networks by government, cooperative and private sectors, and supervising them within the macro-policies of Iran.
f. To conduct study and research, develop technology and hold special practical trainings in the field of space science and technology development.
g. To examine the needs for execution of satellite projects and other required technologies in order to expand space technology within the framework of the relevant laws and regulations.
h. To participate in execution of national, regional and international satellite projects within general policies of the government and related laws and regulations.
i. To exercise the assigned governing duties through offering space signals (sound, image and data) to the applicants in ground sector; grant permission for activity in space in line with integrated management of the space sector in Iran; and consistent and coordinated utilization of space technology and facilities including satellites, private or national satellite networks (including satellite cell-phone), direct receiving stations, direct transmitting and satellite control stations within the framework of the relevant laws and regulations.
j. To collect approved tariffs against offering space services and grant permission of activity in the space.
k. To determine qualifications of non-government contractors and consultants for execution of space administrative and research activities in different sectors in Iran within the framework of the relevant laws and regulations.
l. To represent, acquire membership and participate in related regional and international forums and unions in order to safeguard national interests within the framework of general policies of the government and the relevant laws and regulations.
m. To implement regional and international cooperation plans regarding the space within the framework of general policies of the government.
n. To manage and utilize orbital and satellite positions and coordinate with competent bodies to follow up their international registration for the purpose of optimal use of space sources.
o. To study and plan for the supply of the space sector required by all satellite networks of Iran to render satellite services by means of national, regional and international satellites within the framework of laws and regulations.
p. To prepare and compile regulations and by-laws related to the job descriptions provided in the article (9) of the Act for Duties and Powers of Ministry of Communications and Information Technology adopted in 2003, and submit them for the approval of legal authorities.
q. To establish a national archive and focus on keeping, classifying and updating of space information.
Note 1: The Agency shall be obliged to use the highest potentials of no-government sectors in order to execute its duties and responsibilities within the framework of general policies of the government.
Note 2: Related competent authorities shall be responsible for determination of the security qualification provided in clauses “i” and “k” of this article.
Note 3: In order to carry out its duties the Agency shall be authorized to establish a space research center (research institute or center) with the approval of the State Council for Expansion of Higher Education and also set up a company within the framework of laws and regulations.
Note 4: As for clause “j” of this article, the Agency has to deposit the revenues based on the rates to be approved by the Council of Ministers, to the general revenue account (at Treasury General). As much as one hundred percent (%100) of the credits mentioned among the credits of the budget law shall be allocated to the Agency to be spent upon exchange of agreement with Office of the Vice-President for Strategic planning and Supervision.
Article 4: The credits required by the Agency shall be predicted and provided in the general funds and credits of the annual budget of the country and shall be spent within the framework of special by-laws of the Agency subject to the article (2) of the present articles of association and other related laws and regulations.
Note: The Agency may in coordination with the Office of the Vice-President for Strategic planning and Supervision and within the framework of its annual budget use the grants and other credit resources of Ministry of Communications and Information Technology and its affiliate organizations and companies as well as other institutions.
Article 5: By virtue of clause “10” under the article (68) of State Services Management Act, adopted in 2007, the Agency may in coordination with Office of the Vice-President for of Management and Human Resource Development pay necessary remunerations for recruitment and retention of proper workforce for specialized and management positions with the approval of the Council of Ministers.
Article 6: Structural chart of the Agency shall be implemented upon compilation by the Agency and ratification of the Office of the Vice-President for of Management and Human Resource Development.
Article 7: President of the Agency who is Deputy Minister of Communications and Information Technology shall be appointed by the Minister and shall act as the highest executive authority of the Agency.
Article 8: President of the Agency shall be responsible for the good performance of the business of the Agency and protection of rights, interests and properties of the Agency and shall have absolute rights and powers within the regulations for the operation of the Agency. The president of the Agency shall represent the Agency before all judicial authorities and natural and legal persons with the right of assigning power of attorney to third persons. The president may assign part of its powers to a deputy present of the Agency, a manager or a worker of the Agency in writing at his/her own discretion and responsibility.
The present Articles of Association have been approved by the Council of Constitutional Guardians as per the letter number 87/30/27483 on 2 July 2008.
The present Resolution of the Council of Ministers was notified to Ministry of Communications and Information Technology under Number: H 38571 T/ 62999 dated 16 July 2008.
